The undersigned being the parties at interest in this matter have agreed to submit the dispute now pending between them to Massachusetts Dispute Resolution Services and have entered into a separate Agreement for Binding High Low Arbitration. Section B of that Agreement For Binding High Low Arbitration incorporates by reference this confidential document which sets forth the high and low limits on the arbitration award in this matter.

The parties agree that the arbitration award in this matter will be limited to a low award of_____________ and a high award of______________.

These high and low limits shall not be disclosed to the arbitrator in this matter. Subject to these high and low award limits, the arbitrator’s award may be entered as a final judgment in any court of competent jurisdiction.  This Confidential High Low Agreement may be executed in several counterparts, each of which shall be deemed an original, but all of which shall be considered one valid and enforceable agreement.
