Why MDRS?
Our mediation and arbitration services offer many benefits to the parties, whether or not they are represented by counsel.

In addition, did you know that there are a number of ways to resolve civil disputes without having to sue somebody? These alternatives to a lawsuit are known as alternative dispute resolution (ADR). The most common forms of ADR are Mediation, Arbitration, and Settlement Conferences.

Advantages of Alternative Dispute Resolution (ADR)
ADR processes have a number of advantages. They are flexible, cost-efficient, time-effective, and give the parties more control over the process and the results.

Parties who resolve their disputes through ADR are generally more satisfied because they may directly participate in working out the terms of their settlement. When appropriate settlement processes are available, many disputes can be resolved more efficiently and with greater satisfaction to all parties. ADR in Massachusetts

Rule 5 requires courts to make information about ADR available to attorneys and unrepresented litigants. Attorneys must provide the information to their clients, discuss the advantages and disadvantages of ADR, and certify their compliance with this requirement. Trial Court departments will receive a model form for attorney certification, which may be adapted for use as appropriate.
